Why Caddell Reynolds

How Our Fayetteville Personal Injury Lawyers Can Help

You and your family have already been through enough. You shouldn’t have to fight an insurance company while you’re dealing with doctor’s visits, medical bills, and lost wages. Our Fayetteville personal injury lawyers are ready to shoulder your insurance and legal burdens, as they’ve done for countless other clients before:

Investigating the Circumstances

Our team digs into exactly what happened leading up to your accident or incident. We gather police reports, photos, medical records, and any available documentation to build a complete picture of the events.

Establishing Liability

We carefully examine the facts to identify evidence of negligence or wrongdoing by the responsible parties. This foundation is critical to proving your case and holding the right people accountable.

Gathering Witness and Expert Accounts

We track down eyewitnesses and interview them while their memories are fresh. When needed, we also secure expert testimony from professionals whose insights can strengthen your claim.

Calculating Your Damages

We add up every cost your accident has created, from medical bills and lost wages to pain, suffering, and long-term impacts. This ensures you seek the full compensation you're entitled to, not just the obvious expenses.

Filing Your Claim

We prepare and file your claim against the correct defendants and applicable insurance policies. Getting this step right from the start prevents costly delays and protects your right to recover.

Handling Communications

We field every call, letter, and inquiry from the other side so you don't have to. This protects you from saying anything that could be used against your case and keeps the process moving forward professionally.

Bringing in the Experts

When a case calls for it, we engage accident reconstruction specialists, medical experts, and other professionals to reinforce your claim. Their analysis can turn a disputed incident into a clear, well-supported argument.

Negotiating a Fair Settlement

We push hard for a settlement that fully reflects what you've been through, so you can move on with your life. Our goal is to resolve your case efficiently without ever shortchanging what you deserve.

Taking Your Case to Court

If the other side refuses to offer a fair resolution, we're fully prepared to bring your case before a judge and jury. We treat every case as if it might go to trial, which strengthens our position at the negotiating table.

Following Up After Your Case

Our relationship doesn't end when your case closes. We check in afterward to address any lingering concerns and make sure you have the support you need to move forward with confidence.

Why Caddell Reynolds

Don’t Assume You Can’t Afford Legal Representation

At Caddell Reynolds, we believe insurance companies shouldn’t be able to win just because an injured claimant lacks the financial resources to hire an attorney. Our Fayetteville personal injury lawyers take cases on a contingency-fee basis. That means:

  • You pay nothing when you hire us, and nothing while your case is pending
  • There are no hourly charges, no retainers, and no surprise fees.
  • If we don’t recover compensation for you, you don’t owe us a dime.

Because we only get paid if you win, you can be confident that our team will work tirelessly and aggressively to maximize your financial recovery. We understand how insurance companies operate, and we know how to make them pay.

FAQs

Fayetteville Personal Injury Lawyers: Frequently Asked Questions

What is a personal injury case?

A personal injury lawsuit is a legal action that an injured person files against another individual or entity that caused them harm. These are civil cases, not criminal proceedings, and plaintiffs typically seek financial compensation against the defendant responsible for their injuries and losses. In addition to the person who suffered harm due to the defendant’s action, parents and guardians can also file a personal injury claim on behalf of minor children. If another party’s actions caused the death of a loved one, certain surviving family members also have a right to seek compensation for their losses through a wrongful death lawsuit.

How much is a personal injury claim worth?

Every personal injury claim is unique, and that’s not a question we can answer immediately. The value of your case will ultimately depend on the severity of your injuries and the circumstances of the accident or incident that caused you harm. However, in the states served by our Fayetteville personal injury lawyers, successful plaintiffs can be awarded economic and non-economic damages for:

  • Medical bills and future medical expenses
  • Lost wages, salary, and other forms of income
  • Loss of future earning capacity
  • Property damage
  • Pain and suffering
  • Emotional distress
  • Loss of consortium

In rare cases where a defendant’s conduct was particularly egregious, courts can also award personal injury punitive damages. Unlike economic and non-economic damages, these damages are not intended to compensate the plaintiff, but to punish the defendant and deter similar conduct in the future.

What if I was partially responsible for my injuries?

All of the states served by our Fayetteville personal injury lawyers have enacted comparative fault laws, which means that even if you are partially to blame for your injuries, you may still be able to recover reduced compensation.

  • In Arkansas, you can still recover compensation as long as you are found to be 49% or less at fault. However, if your share of blame reaches or exceeds 50%, your claim is barred in its entirety. Your share of fault also directly reduces your recovery — so a finding of 30% fault on a $200,000 case means you walk away with $140,000, not $200,000.
  • In Missouri, the standard is more forgiving. Missouri follows a pure comparative fault rule, which means you can recover compensation regardless of how much blame is attributed to you — even if you were more to blame than the defendant. However, your recovery is also reduced in proportion to your share of fault.
  • In Oklahoma, you can recover as long as your share of fault does not exceed 50%. As in Arkansas and Missouri, your financial recovery is reduced proportionately by the percentage of fault assigned to you.

In complex personal injury claims—such as a multi-vehicle car crash—determining fault can be highly contentious. Insurance companies and their attorneys will seek to shift as much blame as possible to you in an attempt to reduce your payout. When they do, our team will push back just as aggressively to ensure that fault falls where it belongs.
