Witness testimony may also be provided by others on the road who observed the intoxicated driver operating their vehicle erratically.<\/li>\n<li><strong>BAC level<\/strong>: A BAC level above .08% can establish strong evidence of negligence in a drunk driving accident lawsuit.<\/li>\n<li><strong>Expert witness testimony<\/strong>: An expert witness can provide testimony about various issues to help hold an establishment accountable.
